The Website www.powerdek.co.za sells tools and equipment online. The use of any product bought from this Website is at the purchaser”s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.
The private information required for executing the orders placed through the e-commerce facility, namely the User”s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.
The Provider undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. The Provider cannot be held responsible for security breaches occurring on the User”s electronic device (Personal Computer or other electronic device used to browse the Website),
This may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.
Limitation of liability
The Website and all Content on the Website, including any current or future offer of products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy or completeness of the Content. Neither Provider nor any holding company, affiliate or subsidiary of Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if Provider is expressly advised thereof
Subject to stock availability with suppliers and receipt of payment, requests will be processed within 14 days and handed over to a courier company for delivery. Unless otherwise specified, For very remote areas not serviced by standard couriers The Provider will deliver via Post Office(depending on size of parcel), or to the nearest town to the User that is accessible by a courier company within their normal routes. In these circumstances the Provider will be in contact with the User to arrange an alternative address.
The Provider will supply all goods to the delivery company in good order and will ensure that goods arrive at the User”s chosen delivery address in the same good order.
Parcel Returns Policy
Products may not be returned unless the incorrect product has been supplied by Powerdek or the product is damaged or faulty.
Returned items should be unused and must be returned in original packaging with any enclosed documentation. We will issue a full refund on receipt, excluding the original delivery charge. Alternatively, if preferred, we will exchange the item.
Goods will only be accepted for return if they are despatched within 14 days of delivery, unless we have notified you otherwise.
The item is your responsibility until it reaches us. Therefore, for your own protection we recommend that you send the parcel using a delivery service that insures you for the value of the goods.
The cost of returning the item to us is your responsibility.
Delivery charges are only refundable where goods are faulty and a refund is made.
Repair Service Terms and Conditions
Thank you for your interest in Powerdek’s Repair Service! If your machine is out of warranty, or has been damaged due to use or abuse not covered by the warranty, Powerdek,is pleased to offer you repair services under the following terms and conditions (the “Agreement”). Your use of the Repair Service constitutes your acceptance of this Agreement
The intent of the Powerdek Repair Service is to provide you with a repaired or refurbished Powerdek product when your original product requires non-warranty service or repair. (“Repair Service”) Warranty repairs for any Powerdek products covered by the Powerdek warranty (“Warranty Service”) are covered by your Exclusive Limited Warranty, not this Agreement, except as provided for below
Warranty and Disclaimer
Repaired Products under this Agreement are covered by Powerdek Warranty for 90 days from the date of replacement or repair as “a replacement product or part” or for the remaining term of your original limited warranty period, whichever is longer. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMLABS AND ITS AFFILIATES, WILL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM PERFORMANCE OF ANY REPAIR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, OR CORRUPTION OF DATA. THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS. FORMLABS SPECIFICALLY DOES NOT WARRANT THAT IT WILL BE ABLE TO REPAIR OR REPLACE YOUR PRODUCT. IF ANY PRODUCT SHOULD BE DAMAGED OR LOST WHILE IN FORMLABS’ CUSTODY, FORMLABS’ LIABILITY WILL BE LIMITED TO THE COST OF REPAIR OR REPLACEMENT OF THE AFFECTED PRODUCT. OTHERWISE, FORMLABS’ LIABILITY FOR ANY AND ALL DAMAGE SHALL IN NO EVENT EXCEED THE PAYMENTS RECEIVED BY FORMLABS FOR SERVICES PROVIDED PURSUANT TO THESE TERMS. THE REMEDIES SET FORTH HEREIN SHALL BE YOUR SOLE AND EXCLUSIVE REMEDIES FOR ANY BREACH BY FORMLABS UNDER THESE TERMS AND CONDITIONS.
